The Stretch App terms of use

These terms are an agreement between you and Indimakes (“we”, “us”) for your use of The Stretch App (“the app”). By downloading or using the app you agree to them. If you don’t agree, please don’t use the app.

Our general Terms of service also apply to the app, including the sections on arbitration, time limits on claims, and governing law. Where they differ from this page, this page applies to The Stretch App. How we handle your information is described in The Stretch App privacy policy.

The Stretch App provides general fitness information only. It is not medical advice. Stretch gently, stop if anything hurts, and talk to a doctor before starting if you are injured, pregnant or have a medical condition.

Using the app

You must be at least 13 years old, or the minimum age in your country, to use the app. If you are under 18, you need a parent’s or guardian’s permission.

We give you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by the App Store’s usage rules. You may not copy, modify, reverse engineer, resell or redistribute the app or its content, except where the law allows it.

Health and safety

The routines, timings and guidance in the app are general information for healthy adults. They are not a diagnosis, treatment or substitute for advice from a doctor, physiotherapist or other qualified professional.

Check with a doctor before you start if you have an injury, a medical condition, recent surgery, or are pregnant.
Stretch within a comfortable range. Stop straight away if you feel pain, dizziness or shortness of breath.
Make sure the space around you is clear and safe before a session.
You use the app at your own risk and are responsible for deciding whether an exercise is suitable for you.

Your account

You don’t need an account to use the app. If you create one, for example for cloud backup, you are responsible for keeping your sign-in details safe and for activity under your account. You can delete your account at any time in Settings › Delete account.

Premium subscriptions

Some features need Premium, an optional auto-renewing subscription offered as a yearly or a monthly plan. The price, the length of each plan and any free trial are shown in the app before you buy.

Payment is charged to your Apple Account when you confirm the purchase.
The subscription renews automatically at the end of each period, at the price shown, unless you cancel at least 24 hours before the period ends.
Free trial: where a free trial is offered, it is for new subscribers only. When the trial ends, the plan you chose starts and you are charged, unless you cancel at least 24 hours before the trial ends.
Managing and cancelling: you can manage or cancel your subscription in your App Store account settings. Deleting the app does not cancel a subscription.
After you cancel, Premium stays active until the end of the period you have paid for.
Restoring: Premium belongs to the Apple Account that bought it. Use Restore purchases in the app to get it back on another device signed in to the same Apple Account.

Refunds

Purchases are processed by Apple, and refunds are handled by Apple under its own policies. You can request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves. Nothing in these terms limits refund or cancellation rights you have under the law where you live.

Price and feature changes

We may change subscription prices or what Premium includes. Price changes for existing subscribers are notified in advance through Apple and, where required, need your agreement. If you don’t accept a change, you can cancel before it takes effect.

Free version and ads

The free version of the app is supported by advertising and includes a limited set of routines and features. Ads are provided by third parties; we don’t endorse the products or services advertised, and your dealings with advertisers are between you and them.

Your content

Routines you build and the names you give them remain yours. If you use cloud backup, you allow us to store and process that content only to provide the backup to you. Cloud backup is a convenience and not a guaranteed archive; we are not liable for loss of data.

Our content

The app, including its routines, illustrations, text, design and trademarks, belongs to Indimakes or its licensors and is protected by intellectual property laws. Share cards the app creates for you may be shared freely for personal, non-commercial use.

Acceptable use

Don’t use the app for anything unlawful.
Don’t interfere with the app or the services behind it, try to get around its limits or payment, or access it by automated means.
Don’t use the app’s content to build a competing product.

Third-party services

The app relies on services from Apple, Google and RevenueCat, and can save workouts to Apple Health if you turn that on. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services.

Changes to the app and these terms

We may add, change or remove features, and we may stop offering the app. If we stop offering it, a subscription you have already paid for continues until the end of its period where possible, and Apple’s refund process remains available to you.

We may update these terms. We’ll change the date above and, for significant changes, tell you in the app or in its App Store listing. Continuing to use the app after a change means you accept the updated terms.

Ending these terms

You can stop using the app at any time by deleting it; remember to cancel any subscription separately. We may suspend or end your access if you seriously or repeatedly break these terms. The sections on health and safety, our content, disclaimers and liability continue to apply after these terms end.

Disclaimers and liability

The app is provided “as is” and “as available”. To the extent the law allows, we make no warranties about it, including that it will be uninterrupted, error-free, or suitable for your particular needs or physical condition.

To the extent the law allows, Indimakes is not liable for any injury, health problem, loss of data, or indirect or consequential loss arising from your use of the app, and our total liability to you is limited to the amount you paid for the app in the 12 months before the claim. Some countries don’t allow these limits, so they may not apply to you, and nothing in these terms limits liability that cannot be limited by law.

Apple App Store terms

If you downloaded the app from the Apple App Store, the following also applies:

These terms are between you and Indimakes only, not Apple. We, not Apple, are responsible for the app and its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
Apple is not responsible for addressing claims by you or anyone else relating to the app, including product liability claims, claims that the app fails to meet a legal requirement, and consumer protection or privacy claims.
If someone claims the app infringes their intellectual property rights, we, not Apple, are responsible for handling that claim.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
